Terms of Service

These terms are the agreement between you and PUNCH for using the app and website. By creating an account or using PUNCH, you agree to them. If you don't agree, don't use the service.

2. Your content and the license you grant

You own what you post. To run the service, you grant PUNCH a non-exclusive, worldwide license to host, store, display, and distribute your content on PUNCH so we can show it to the people you intend. We distribute your content beyond PUNCH only when you explicitly choose to (for example, opting in to cross-posting). You can delete your content at any time, which ends that license going forward (subject to backups and legal retention).

3. Acceptable use

You agree not to use PUNCH for anything prohibited by our moderation policy, including (without limit): illegal content, child sexual abuse material, credible threats or incitement to violence, targeted harassment, spam, fraud, or attempts to break, overload, or scrape the service.

4. Moderation and enforcement

We enforce our policies transparently. When we remove content or restrict an account, we tell you why where we can, and you can appeal. We do not use unexplained shadowbans. Serious or repeated violations can lead to suspension or permanent removal.

5. Intellectual property and DMCA

Respect others' rights. If you believe content on PUNCH infringes your copyright, send a notice to our designated agent at hello@punchsocial.co with the information required under the DMCA. We respond to valid notices and counter-notices and may remove infringing content.

6. Payments, subscriptions, and creator earnings

Paid features (such as PUNCH Pro) and creator monetization (tips, subscriptions) are processed by Stripe. Subscriptions renew until canceled. Creator payouts are subject to identity verification, platform fees disclosed at the time, and applicable taxes. Purchases made through the Apple App Store or Google Play are also subject to those stores' terms.

7. Termination

You can stop using PUNCH and delete your account at any time (Settings → Account). We may suspend or terminate accounts that violate these terms or create risk for the platform or other users, with notice where appropriate and a right to appeal.

8. Disclaimers

PUNCH is provided "as is" and "as available." We work hard to keep it reliable and safe, but we don't guarantee it will be uninterrupted, error-free, or that content posted by others is accurate or appropriate.

9. Limitation of liability

To the maximum extent permitted by law, PUNCH is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the greater of the amount you paid us in the prior 12 months or $100.

10. Indemnification

You agree to cover claims arising from your misuse of PUNCH or your violation of these terms or the law, to the extent permitted by applicable law.

11. Dispute resolution

Most disputes can be resolved by contacting us first. Where binding arbitration applies, you may opt out within 30 days of accepting these terms by emailing us. Nothing here prevents you from bringing eligible claims in small-claims court.

12. Governing law

These terms are governed by the laws of the State of Hawaii, United States, without regard to conflict-of-laws rules, except where local consumer-protection law gives you stronger rights.

13. Changes to these terms

We may update these terms as PUNCH evolves. We'll note the date above and, for materially adverse changes, give you at least 30 days' notice in-app or by email before they take effect.
